Terms for OffTrail Events.

The agreement

These terms apply to anyone who creates an organiser account on OffTrail Events, and to anyone who registers for an event through it. The platform is published by Ricardo Costa ("we", "us"); contact [email protected]. If you don't agree with these terms, don't create an organiser account or register for an event through OffTrail Events.

What OffTrail Events is

OffTrail Events is a platform for organisers to publish adventure motorcycling, off-road and outdoor events, manage registrations, and share the event route with confirmed participants — and for you to find and register for those events. OffTrail Events is the registration and organisation tool; it does not run, supervise or guarantee the physical event, which remains entirely the organiser's responsibility. Organiser responsibilities

If you create an organiser account and publish events, you are responsible for:

• The accuracy of the information you publish (dates, location, fees, what's included) and updating it if it changes.
• The legality and safety of the event itself, obtaining any permits, permissions or land access it needs, and complying with applicable law.
• The data processing agreement. The relationship between you (controller) and OffTrail (processor) for participant data is set out in the data processing agreement, accepted when you create an organiser account.
• The information you collect. The questions you add to the registration form are yours: under data protection law you are the controller of your event's participant data, and OffTrail processes it on your behalf, on your instructions. By using Events you confirm that you ask only for what you have a lawful basis to collect, that you tell participants why you're asking, and that you obtain any consent the law requires, including where a question involves special categories of data. Don't use form fields to collect information you cannot lawfully collect.
• Who sees what. Managing your team's access according to what each person needs to see, and deleting registrations and answers once the event no longer needs them. OffTrail gives you the access, export and deletion tools; when and what to delete is your call.
• Giving accurate payment instructions and reconciling payments promptly and honestly; OffTrail's reconciliation tools only detect and suggest matches — you confirm them.
• Managing who on your team has access to your organisation's events and registrations, and removing access when someone leaves your team.
• Responding to participants' requests about their own data (access, correction, deletion) for the data you collected. OffTrail helps you answer; it doesn't decide for you.

Participant responsibilities

If you register for an event, you are responsible for:

• Giving accurate registration information, and updating it (or contacting the organiser) if it changes before the event.
• Reading and following the specific event's own participation terms and any waiver shown at registration.
• Following the organiser's on-site instructions, applicable law, and land-access rules during the event.
• Your own safety, equipment, and riding or driving decisions during the event, in the same spirit as the OffTrail app terms — the event's route, like any navigation aid, is not a guarantee of safety.
• Sharing your live location with the organising team where the event uses live tracking, for the duration of the event, and using the check-in flow (QR code or code entry) honestly.

Payments

OffTrail never processes payments and never sees your card, bank or payment-instrument details. You pay the organiser directly, using the method and reference they provide; a payment dispute (wrong amount, no confirmation, refund) is between you and the organiser. Where an event has a fee, OffTrail may charge the organiser separately to use the platform (a service fee), which is unrelated to what a participant pays the organiser to attend.

Liability

OffTrail Events is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by applicable law, OffTrail does not accept liability for the conduct, safety, cancellation or outcome of an event — that responsibility sits with the organiser — nor for payment disputes between a participant and an organiser, which OffTrail does not process or guarantee. Nothing in these Terms excludes or limits liability, consumer rights or remedies that cannot legally be excluded or limited.

Cancellations and refunds

Cancellation and refund policies for a specific event are set by its organiser, not by OffTrail; check the event's own terms before registering. You can cancel your own registration at any time from your personal event page, which removes your registration data as described in the Events privacy policy — this does not by itself entitle you to a refund, which is the organiser's decision under their stated policy.

See the Events privacy policy for what's collected when you organise or register for an event, who sees it, and how long it's kept.

Availability and discontinuation

OffTrail Events does not guarantee uninterrupted or error-free availability. We may change or discontinue features of the platform; where reasonably possible, we'll give organisers notice before a change that materially affects a published, upcoming event.

Your consumer rights

Nothing in these Terms removes mandatory rights that apply to you under consumer or other applicable law.

Governing law and disputes

These Terms are governed by Portuguese law, without prejudice to mandatory rights or protections that may apply to consumers in their country of residence. Any dispute that can't be resolved by writing to [email protected] first may be brought before the competent courts; EU consumers keep the right to bring a complaint in their country of residence.

Changes to these terms

We may update these terms as OffTrail Events changes. The "Last updated" date at the top of this page reflects the most recent change; material changes are also signalled where relevant (for example on the organiser dashboard or the registration page).

Language versions

OffTrail Events publishes these terms in English, Portuguese and Spanish. The three versions are intended to express the same terms, and any interpretation must remain consistent with applicable law.
